1. Agreement to Terms

These Terms of Service ("Terms") constitute a binding agreement between you and NosferTech ("we," "us," "our," "Company") governing your use of the Wares & Heroes mobile game and related services ("Game"). By downloading, installing, or playing Wares & Heroes, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Game.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use Wares & Heroes on your personal Android mobile device solely for your own entertainment and personal use. You may not sell, rent, lease, transfer, assign, or sublicense the Game or any of its components.

3. Acceptable Use

You agree to use Wares & Heroes only for lawful purposes and in ways that do not infringe upon the rights of others or restrict their use and enjoyment of the Game. Prohibited behavior includes:

  • Harassment, threats, or abusive language directed at other players
  • Cheating, hacking, or using exploits to gain unfair advantages
  • Attempting to gain unauthorized access to the Game's systems or servers
  • Reverse-engineering, decompiling, or modifying the Game
  • Using bots, scripts, or automated tools to manipulate gameplay
  • Sharing accounts or attempting to sell in-game currency or items for real money outside the official channels
  • Spamming, phishing, or distributing malware

4. In-App Purchases

  • Billing: In-app purchases are processed through Google Play Billing. All transactions are final and non-refundable except where required by law
  • Account Responsibility: You are responsible for all purchases made through your Google Play account. We are not responsible for unauthorized purchases made on your account
  • Purchased Items: In-app purchases grant you access to virtual in-game currency or items that exist solely within the Game. These items have no real-world value
  • Refund Policy: Refund requests must be submitted through Google Play within 48 hours of purchase, subject to Google's policies

5. Advertising

Wares & Heroes contains advertisements served by Google AdMob. These ads may be targeted based on your interests and gameplay data. By using the Game, you consent to the display of advertisements. You may have options to limit ad personalization in your device's settings. We are not responsible for the content, accuracy, or practices of third-party advertisers.

6. Game Progress & Data

  • Local Storage: Your game progress is stored locally on your device. You are responsible for backing up your data
  • Cloud Saves (Optional): If you enable cloud saves through Google Play Games Services, your progress may be synced to Google's servers
  • Data Loss: We are not responsible for loss of game progress due to device deletion, reinstallation, factory reset, or other actions taken by you or your device
  • Server Maintenance: We reserve the right to perform maintenance that may temporarily disrupt access to the Game

7. Intellectual Property Rights

All content, graphics, audio, gameplay mechanics, code, and other intellectual property in Wares & Heroes are owned by or licensed to NosferTech and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or transmit any Game content without our express written permission.

8. Modifications & Termination

We reserve the right to modify, suspend, or discontinue Wares & Heroes (or any part thereof) at any time with or without notice. We are not liable to you for any modification, suspension, or discontinuation of the Game. Your access to the Game may be terminated if you violate these Terms. Upon termination, your right to use the Game ceases immediately.

9. Disclaimer of Warranties

Wares & Heroes is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the Game's functionality, availability, or fitness for any particular purpose. We do not warrant that the Game will be uninterrupted, error-free, or free from viruses or harmful components. Your use of the Game is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, NosferTech shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising from your use or inability to use the Game, regardless of the cause and whether or not we have been advised of the possibility of such damages.

11. User-Generated Content

If Wares & Heroes includes features where you can create, upload, or share content, you grant NosferTech a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content for purposes of operating and improving the Game. You represent and warrant that you own or have the necessary rights to all content you create or share.

12. Third-Party Services & Links

Wares & Heroes may integrate with third-party services (Google Play, Firebase, AdMob, Google Play Games Services). These services are governed by their respective terms of service and privacy policies. We are not responsible for the practices, content, or policies of third-party services.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the courts located in Spain.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Game store listing or within the Game. Your continued use of Wares & Heroes after changes constitute your acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if such modification is not possible, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and NosferTech regarding your use of Wares & Heroes and supersede all prior negotiations, understandings, and agreements.
